Rules that govern your use of the app, including gameplay, payments, account use, and dispute resolution.

1. Introduction & Acceptance

1.1 Purpose

These Terms and Conditions (“Terms”) govern your use of the Payday Fantasy Fantasy platform, operated by BetScoop Inc. dba Payday Fantasy (“Payday,” “we,” “us,” or “our”). They are a legally binding agreement between you and Payday.

1.2 Agreement

By accessing or using our platform—including browsing, registering an account, or participating in any gameplay—you confirm that you understand and agree to these Terms. If you do not agree, you may not access or use the platform.

1.3 Updates

We may change or update these Terms at any time, for any reason, without prior notice. Updated Terms become effective immediately upon being posted to the platform. Continued use after updates means you accept the revised Terms.

1.4 Electronic Communications and Signatures

By accessing or using the platform, you consent to receive these Terms, notices, disclosures, updates to these Terms, and other communications related to your account and use of the platform electronically — including via email, in-app notification, or by posting to the platform — rather than in paper form. You agree that your electronic acceptance of these Terms, and any electronic signature, click-through consent, or other electronic indication of assent you provide in connection with the platform, has the same legal effect as a handwritten signature under the U.S. Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and applicable state law. You are responsible for maintaining a valid email address and a device capable of receiving electronic communications. You may withdraw this consent at any time by closing your account; however, because continued electronic delivery of these Terms and account-related notices is necessary for us to provide the platform, withdrawing consent will require you to stop using the platform.


2. Eligibility & Account Creation


To access or participate in paid-entry gameplay on Payday Fantasy, you must meet all of the following requirements:

2.1 Age/Residency Requirements
You must meet the minimum age requirement mandated by the laws and regulations of the U.S. state in which you are physically located at the time of gameplay. Where a state imposes a higher minimum age, that higher age requirement will apply.

2.2 Location Requirement
You must be physically located in a U.S. state where Payday Fantasy gameplay is legally offered at the time you access or participate in gameplay. Eligibility is determined by real-time geolocation verification, which may be required each time you attempt to access paid gameplay.

If your location cannot be verified, or if you are not located in a state where gameplay is offered, access to paid gameplay will be restricted.

2.3 Eligibility Criteria
To participate, you must:

  • Be a U.S. resident

  • Possess a valid Social Security Number

  • Provide a valid, government-issued photo ID for identity and age verification

  • To participate, you must complete our Know Your Customer (KYC) and Anti-Money Laundering (AML) verification process. This includes verifying your age, identity, and location using secure third-party services. If you fail or refuse verification, your access to the platform may be limited or denied.

  • Maintain a U.S. checking or savings account to deposit or withdraw funds


2.4 Eligibility Account Criteria
Each individual is allowed only one account. Creating multiple accounts or accessing another user’s account is prohibited and may result in suspension, permanent ban, or forfeiture of funds.

2.5 Account Security

You are responsible for maintaining the confidentiality of your login credentials. Any actions taken through your account are your responsibility, whether or not you authorized them. Notify us immediately if you suspect unauthorized access.

2.6 State Availability and Registration Status

Payday Fantasy is only available to users physically located in states where paid-entry fantasy sports contests are legally permitted. As of the date of these Terms, our real-money contests are unavailable to residents of, or users physically located in: Alabama, Arizona, Colorado, Connecticut, Delaware, Hawaii, Idaho, Indiana, Iowa, Louisiana, Maine, Maryland, Massachusetts, Michigan, Mississippi, Missouri, Montana, Nevada, New Hampshire, New Jersey, New York, Ohio, Pennsylvania, Tennessee, Vermont, Virginia, Washington. This list may change as state laws and our compliance status evolve. The current list of restricted states is maintained at https://paydayfantasy.com/states.

In states that require operator registration, licensure, or a specific consumer disclosure for paid-entry fantasy contests, Payday Fantasy maintains registration in accordance with applicable state law. State-specific registration numbers and required consumer protection disclosures, where applicable, are available upon request to [email protected].


3. Platform Use & Licenses

3.1 Limited License

You are granted a limited, revocable, non-transferable, non-exclusive license to access and use our platform solely for your personal, non-commercial use, and in accordance with these Terms.

3.2 Restrictions

You agree not to:

  • Reverse engineer, decompile, or disassemble any part of the platform;

  • Use bots, scrapers, or automated tools to access or interact with the service;

  • Interfere with the platform’s security, infrastructure, or data integrity; or

  • Use the platform in any unlawful or unauthorized manner.

Violations may result in suspension, permanent account ban, or legal action.

3.3 App Store Compliance

When using our mobile apps, you must also comply with the applicable app store’s terms (e.g., Apple App Store or Google Play Store). These third-party terms apply in addition to ours and may affect your rights and obligations.


4. Account Deactivation, Termination, and Effect on Funds

4.1 User-Initiated Account Deactivation

If you voluntarily deactivate, close, or delete your account for any reason, this action is considered a user-initiated account deactivation. This includes, without limitation, deactivation through account settings, written requests to customer support, or any other request made by you that results in your account being closed or rendered inactive.


4.2 Effect of User-Initiated Deactivation on Funds and Gameplay

Upon user-initiated account deactivation:

  • All remaining funds in your account are forfeited

  • Any pending, unsettled, or future credits are voided

  • All bonus funds, promotional credits, rewards, and incentives are immediately forfeited

  • Any open or unsettled gameplay, marketplace activity, or commissions are canceled and voided

  • No withdrawals may be requested or processed after deactivation

Deactivated accounts are permanently ineligible to receive any funds, credits, payouts, commissions, adjustments, reversals, or goodwill credits of any kind.

Notwithstanding the foregoing, to the extent forfeiture of any remaining funds is prohibited or restricted by applicable law (including, without limitation, state unclaimed property or consumer protection laws), we will treat those funds in accordance with the requirements of that law rather than forfeiting them, which may include returning the affected funds to you or remitting them to the appropriate state authority as unclaimed property.

You are solely responsible for reviewing your account balance and completing any eligible withdrawals before requesting or initiating account deactivation.


4.3 No Reinstatement or Recovery

Accounts deactivated at the user’s request may be reactivated only at the Company’s sole discretion and only upon an explicit request and approval by the Company. Any such reactivation, if granted, does not restore or reinstate any prior funds, balances, bonuses, credits, rewards, or gameplay, all of which are permanently forfeited, regardless of whether the deactivation was made in error or later disputed.


4.4 Platform-Initiated Suspension or Termination

The Company reserves the right to suspend or terminate accounts at any time for reasons including, but not limited to, suspected fraud, violation of these Terms, failure to satisfy verification requirements, abuse of promotions, or compliance with legal or regulatory obligations.

The treatment of funds for platform-initiated suspensions or terminations will be handled in accordance with these Terms and applicable law and may differ from user-initiated deactivations.


4.5 Acknowledgment

By requesting or initiating account deactivation, you acknowledge and agree that:

  • The deactivation is voluntary

  • The decision is final

  • All remaining funds and credits are forfeited

  • No further claims may be made against the Company relating to the deactivated account


5. Gameplay & Prizes

5.1 Skill-Based Gameplay

All gameplay on Payday Fantasy is based on skill. Winning outcomes are determined by your ability to make accurate predictions, apply strategy, and interpret data. This includes, but is not limited to, real-world athletic performance, fantasy statistics, and other game formats designed around skill-based mechanics. Our offerings emphasize skill is the predominant factor in determining outcomes.

5.2 Entry Fees & Payments

To participate in gameplay, users must submit an entry fee in U.S. dollars using a supported and valid payment method. Your entry is not considered accepted or active until the payment is successfully processed and confirmed.

By submitting payment, you agree to the terms of the entry, including any applicable payout rules and scoring systems. We reserve the right to reject or void any entries where payment is declined, reversed, or disputed. All entry fees and deposits are final and non-refundable, except where explicitly stated in a specific promotion or confirmed platform error.

To fully activate your account and engage in real-money gameplay, you must complete a successful deposit where funds are received by Payday Fantasy. If a deposit is not completed or fails to process, all associated actions—including entries, wagers, or other gameplay—will be voided until verification is complete.

Payday reserves the right to void any placed bets, winnings, or account progress if:

  • The user’s deposit fails to process,

  • Funds are not received within the required timeframe, or

  • Verification requirements are not met.

All users must comply with identity and payment verification processes. Failure to do so may result in restricted account access, the voiding of pending actions or winnings, and potential account suspension.Payday is not responsible for any fees incurred due to failed deposits, user error, or non-compliance with payment or verification requirements.

5.3 Prize Distribution

Prizes are distributed only after all relevant entries have been fully graded and officially marked as final. This grading process includes the verification of official statistics, execution of scoring logic, and internal integrity checks to ensure fair and accurate results. If there is a delay due to pending data, technical complications, or the need for additional review, prize payouts will be processed as soon as the grading and settlement procedures are complete. No prizes will be paid out until all impacted entries are resolved. Payday reserves the right to withhold or void prize payouts in cases involving suspected fraud, gameplay violations, scoring anomalies, or unresolved disputes.

5.4 Statistical Projection and Odds Discrepancy Clause

Payday Fantasy strives to provide accurate and timely statistical projections and odds. However, in the event of a material discrepancy between the projections or odds displayed on our platform and those available in the broader market at the time an entry was placed, Payday Fantasy reserves the right to void any affected entries. This includes discrepancies resulting from single or multiple data errors, regardless of whether the entry was placed before, during, or after the start of the event.

This policy applies uniformly to all users and will be enforced regardless of whether the discrepancy favored or disadvantaged any specific participant. Although we aim to notify affected users as promptly as possible, instant notice is not guaranteed, and users acknowledge that Payday Fantasy is not obligated to provide real-time alerts in such cases.Payday Fantasy reserves the right, at its sole discretion, to void or adjust picks in the following scenarios:

  • Mispriced lines, including:

    • Projections intended for a specific period of play (e.g., full-game, half, or quarter) that were incorrectly listed;

    • Pricing that is clearly inconsistent with prevailing market odds;

  • Player eligibility issues, including but not limited to:

    • Suspensions or disciplinary action;

    • Injury or illness affecting participation;

    • Unforeseen ineligibility due to weather, coach decisions, or event cancellations;

    • A projected play period not being completed (e.g., early exits or shortened games).

Picks may be voided at any time—before, during, or after the event—if any of the above conditions are met. In cases involving board errors, such as invalid match data, incorrect player listings, or odds malfunctions, Payday Fantasy retains full authority to correct, amend, or void any associated picks or entries. All decisions made by Payday Fantasy regarding board errors, pricing discrepancies, or disputed entries are final and binding. Users attempting to exploit errors, suspended plays, or incomplete data to gain an unfair advantage may be subject to account review, suspension, or permanent ban.

5.5 Mistakenly Credited Funds

If funds are mistakenly credited to your account due to a technical malfunction, administrative error, or any other issue, you are required to notify Payday Fantasy immediately upon becoming aware of the error. Failure to report such incidents in a timely manner may result in account suspension, restriction, or termination.

Any funds erroneously credited to your account do not constitute winnings, bonuses, or promotional value. These funds are prohibited from being used for gameplay, withdrawn, or transferred. Any wagers placed using mistakenly credited funds will be voided, and any resulting winnings will be forfeited. Payday Fantasy reserves the right to recover mistakenly credited funds from your account without prior notice. This may include:

  • Deducting the amount from your current balance;

  • Withholding future payouts or withdrawals; or

  • Requesting repayment via alternative means if your account lacks sufficient funds.

You agree to cooperate with all reasonable efforts by Payday Fantasy to recover erroneously credited amounts, including providing requested documentation or authorizations where necessary.

5.6 Bonus & Promotion Terms

Promotional bonuses are limited to one per account, household, or device unless explicitly stated otherwise. Each bonus or promotion is subject to its own terms and conditions, which will be made available at the time of the offer. These terms may include eligibility requirements, expiration dates, usage restrictions, and specific rollover or play-through obligations before withdrawal is permitted. Abuse or misuse of promotional offers may result in forfeiture of bonuses, associated winnings, and possible account suspension or termination.

5.7 — Tax Reporting

If your net winnings from gameplay on Payday Fantasy meet or exceed the thresholds established by the Internal Revenue Service (IRS) or applicable state tax authorities in a calendar year, we are required to report those winnings, and may be required to issue you a Form 1099-MISC, Form 1099-K, or other applicable tax form reflecting the reportable amount. You are solely responsible for reporting and paying any federal, state, or local taxes owed on your winnings, regardless of whether you receive a tax form from us. We may require you to provide a valid taxpayer identification number (e.g., a Social Security Number) as a condition of withdrawing funds, and we may withhold amounts required by applicable law if you fail to provide accurate taxpayer information upon request. Nothing in these Terms constitutes tax advice; please consult a qualified tax professional with questions about your individual tax obligations.


6. Financial Terms

6.1 Deposits & Fraud Checks

All deposits must be made in U.S. dollars using an approved payment method. Every transaction is subject to real-time fraud screening and risk assessment. In some cases, deposits may be temporarily held or reversed pending review. Suspicious or unusual account activity may result in suspension of funds and/or further identity verification requirements.

6.2 Withdrawals & Verification

Withdrawals are only available to verified users and may require additional documentation to confirm identity and prevent fraud. Withdrawal limits may apply based on payment method, user history, and compliance review. We reserve the right to delay or deny withdrawals in cases of suspected fraud, bonus abuse, Terms violations, or pending chargebacks.

6.3 Chargeback Policy

Initiating a chargeback or payment dispute without first contacting Payday support will result in immediate account suspension, investigation, and potential forfeiture of any funds in your account. Repeated or abusive chargeback behavior will result in permanent account termination. Payday reserves the right to recover these amounts using collection agencies, reporting delinquent accounts to credit bureaus, or pursuing legal remedies where necessary. Users are encouraged to resolve all disputes through our support team before contacting their payment provider.


7. Responsible Gaming

7.1 Self-Exclusion Tools

We offer self-exclusion options that allow you to voluntarily suspend your account for a defined period or permanently. During an active exclusion period, you will not be able to access gameplay, deposit funds, or make withdrawals. Requests for reactivation must be submitted in writing and may be subject to a cooling-off period or additional review.

7.2 Deposit Limits

You may request daily, weekly, or monthly deposit limits to manage your spending and support healthy gaming habits. Requests can be made by contacting our support team. Decreases to limits take effect immediately; increases may be subject to a waiting period and confirmation. Additionally, we may impose mandatory deposit limits globally or on an individual basis based on internal risk assessments, observed user behavior, or regulatory obligations. Users are responsible for complying with any deposit caps imposed on their account.

7.3 Problem Gaming Resources

At Payday Fantasy, we are committed to protecting our users by promoting responsible gaming and ensuring everyone can play within their financial means. Our systems are designed to support healthy behavior, and we encourage all players to set personal limits and recognize when to take breaks.

If you feel you're spending too much time or money on Payday, you can request to self-limit or self-exclude. Self-limiting allows continued access to the platform within predefined spending boundaries, while self-exclusion temporarily or permanently restricts access to gameplay. All requests can be made by contacting our Responsible Gaming team at [email protected].

Third parties may also request restrictions on a user’s account due to financial or legal responsibility. To do so, documentation will be required to prove shared financial responsibility, legal dependency, or court-ordered obligations. Payday may request further identity verification to validate the relationship.

8. Prohibited Conduct

8.1 General Violations

You may not use the platform in any manner that violates applicable laws, regulations, or these Terms. This includes, but is not limited to:

  • Engaging in collusion or coordinated behavior that undermines fair play;

  • Manipulating outcomes, using scripts or bots, or attempting to exploit system vulnerabilities;

  • Circumventing geographic restrictions or age limits through falsified data, VPNs, or other obfuscation tools;

  • Harassing, abusing, or threatening other users or Payday staff;

  • Posting or distributing offensive, harmful, or illegal content.

Violations may result in account suspension, forfeiture of funds, or permanent ban without notice.

8.2 Insider Restrictions

Individuals with access to non-public information related to real-world sporting events or Payday operations—including athletes, agents, league officials, and employees—are strictly prohibited from participating in any public gameplay that relates to their areas of insider knowledge. This also applies to anyone with privileged access to platform code, data systems, or moderation tools.


9. Termination & Enforcement

9.1 Account Suspension and Termination

We reserve the right to suspend, restrict, or permanently terminate your account at any time, with or without notice, if we believe you have violated these Terms, engaged in fraudulent or harmful behavior, or pose a risk to the integrity or reputation of the platform. This may include reversal of transactions, forfeiture of winnings, or denial of future access.

9.2 Appeals and Reinstatement

If your account is suspended or terminated, you may contact our support team to request a review. We will consider relevant facts and supporting evidence, but reinstatement is not guaranteed and final decisions rest solely with Payday.

9.3 Survival of Obligations

The termination of your account does not affect provisions of these Terms that are intended to survive, including but not limited to ownership rights, disclaimers, indemnification, limitation of liability, and dispute resolution.


10. Disclaimers & Liability

10.1 "As-Is" and "As-Available" Service

The platform and all associated content, functionality, and services are provided on an “as-is” and “as-available” basis without any warranties, express or implied. We do not guarantee uninterrupted access, real-time accuracy of data, or that the platform will be free of errors or vulnerabilities. Use of the platform is at your own risk.

10.2 Third-Party Content & Services

Our platform may include links or integrations to third-party services, content, or platforms. We do not endorse and are not responsible for the accuracy, availability, legality, or practices of any third-party sites or services. Your use of such services is subject to their own terms.

10.3 Limitation of Liability

To the fullest extent permitted by law, Payday shall not be liable for any indirect, incidental, consequential, punitive, or special damages—including but not limited to loss of profits, data, use, goodwill, or other intangible losses—arising from or related to your access to or use of the platform. This includes, without limitation, any damages resulting from: platform outages, data inaccuracies, technical failures, unauthorized access, or any content or conduct of third parties on the platform.

In no event shall our total cumulative liability for any claims related to these Terms or the platform exceed the greater of (a) one hundred dollars ($100), or (b) the total amount of entry fees you paid to us in the six (6) months immediately preceding the event that gave rise to the liability.

These limitations apply even if we were advised of the possibility of such damages, and regardless of the form of action, whether in contract, tort (including negligence), strict liability, or otherwise.


11. Indemnification

You agree to indemnify, defend, and hold harmless Payday, its parent company, affiliates, directors, officers, employees, agents, licensors, partners, and service providers from and against any and all claims, liabilities, damages, losses, investigations, judgments, awards, costs, or expenses—including reasonable attorneys’ fees—arising out of or relating to:

  • Your access to or use of the platform;

  • Your violation or alleged violation of these Terms;

  • Any content submitted by you or on your behalf;

  • Your participation in gameplay, including entry submissions, payment activity, or prize claims;

  • Your breach of any applicable laws or third-party rights.

This indemnification obligation survives termination of your account and use of the platform.


12. Dispute Resolution

12.1 Informal Dispute Resolution

Before initiating formal proceedings, you agree to contact us at [email protected] to attempt to resolve any issue related to these Terms, your account, or the use of the platform. We will work in good faith to resolve the dispute informally within thirty (30) days of receipt.

12.2 Binding Arbitration and Waiver of Class Actions

If we are unable to resolve the dispute informally, you and Payday agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms or your use of the platform through final and binding arbitration. The arbitration shall be conducted by a single arbitrator through the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. Unless otherwise required by law, the arbitration will be held in the State of Delaware and conducted in English.

Waiver of Class Actions and Jury Trials:

You acknowledge and agree that you are waiving the right to a trial by jury or to participate as a plaintiff or class member in any purported class, consolidated, or representative proceeding. Unless both you and Payday agree otherwise in writing, the arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of a class or representative proceeding.

The arbitrator shall have the authority to grant any relief that would be available in court under law or in equity, and their decision will be final and binding on both parties. Judgment on the arbitration award may be entered in any court having jurisdiction.

This arbitration agreement survives the termination of your relationship with Payday and your use of the platform.

Right to Opt Out of Arbitration

You may opt out of the arbitration agreement and class action waiver in this Section 12.2 by sending written notice to [email protected] within thirty (30) days of the date you first agree to these Terms. Your notice must include your full name, the email address or username associated with your account, and a clear statement that you wish to opt out of arbitration. If you opt out, any dispute between you and Payday will be resolved as set forth in Section 12.4 (Governing Law), and neither you nor Payday will be bound by the arbitration or class-action-waiver provisions of this Section 12.2 with respect to that dispute. Opting out of arbitration does not affect any other provision of these Terms.

12.3 Exceptions

Notwithstanding the foregoing, either party may bring an individual claim in small claims court if eligible, or seek injunctive or equitable relief in court for claims involving intellectual property rights or unauthorized access to the platform.

12.4 Governing Law

These Terms and any disputes arising out of or related to them are governed by the laws of the State of Delaware, without regard to conflict of law principles.

12.5 Regulatory Complaints

If you have a concern about our platform that has not been adequately resolved through the informal dispute resolution process described in Section 12.1, you may also have the right to file a complaint with the state regulatory body responsible for oversight of paid-entry fantasy sports or gaming in your state, where such a body exists. Filing a regulatory complaint is in addition to, and does not replace, the informal dispute resolution and arbitration procedures described elsewhere in this Section 12.


13. Data Privacy

13.1 Data Collection

We collect personal information necessary to verify your identity, protect against fraud, and comply with legal obligations. This may include but is not limited to your name, date of birth, mailing address, email, phone number, government-issued identification, geolocation, IP address, and financial information such as credit card details or banking information.

13.2 Data Use & Sharing

We use your information to facilitate account creation, verify eligibility, enable gameplay, process payments, detect suspicious activity, and provide customer support. We may share your data with trusted third-party service providers for KYC/AML verification, fraud detection, geolocation checks, payment processing, customer service platforms, and regulatory compliance. These providers are bound by data protection obligations and are only permitted to use your data for the services they provide to us.

We may also disclose personal information where required by law or in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

In some cases, Payday may share anonymized, aggregated, or pseudonymized user data with third-party partners for commercial purposes such as analytics, advertising, or research. This data will not include personally identifiable information unless you have provided explicit consent. Where required by applicable law, we will provide a clear mechanism for users to opt-in or opt-out of such data sharing. We do not sell your personal information for profit without your affirmative consent.

13.4 Marketing Communications & Consent


By creating an account, you agree that Payday Fantasy may contact you with promotional offers, new contest or game announcements, bonus and promotional alerts, and other marketing communications through the channels described below, using the contact information you provide. Consent to receive marketing communications is not a condition of creating an account, using the platform, or participating in gameplay.


Email

We may send marketing emails to the address associated with your account. Every marketing email will include a working, one-click unsubscribe link and our current business mailing address.


SMS / Text Messages

If you provide a mobile phone number and affirmatively opt in through the separate SMS consent checkbox presented at account signup or in Settings, we may send you marketing text messages, including promotional offers, contest alerts, and bonus notifications, using an automated system. Message frequency varies. Message and data rates may apply. You may opt out at any time by replying STOP to any message, or by updating your preferences in Settings > Notifications. Reply HELP for assistance. Consent to receive marketing text messages is not a condition of creating an account or participating in any purchase or gameplay, and your mobile carrier's standard terms apply.


Push Notifications

If you enable push notifications for our mobile app, we may send you promotional push notifications in addition to account- and gameplay-related notifications. You may disable marketing push notifications at any time through your device's notification settings or within Settings > Notifications in the app, while continuing to receive non-promotional notifications necessary for account security and platform operation.

Opting Out

You may opt out of any marketing channel at any time by:

  • Following the opt-out or unsubscribe instructions included directly in the communication (e.g., the unsubscribe link in an email, or replying STOP to a text message); or

We will process opt-out requests promptly and, where required by applicable law, within the timeframe mandated by that law. Opting out of marketing communications on a given channel does not opt you out of transactional, account, security, legal, or regulatory notices (such as deposit confirmations, verification requests, or changes to these Terms), which we may continue to send as necessary to operate the platform and comply with applicable law.

13.5 Biometric Information

As part of our identity verification (KYC) process, we use Plaid Inc. ("Plaid"), an independent third-party identity verification provider, to confirm your government-issued photo ID and verify your identity. This process may involve Plaid's collection and analysis of biometric identifiers or biometric information, such as a scan of facial geometry derived from your photo ID and a live selfie image ("Biometric Data").

Plaid, not Payday Fantasy, collects, processes, and retains your Biometric Data as part of this verification process, in accordance with Plaid's own privacy policy and applicable law, including, where applicable, the Illinois Biometric Information Privacy Act (BIPA), the Texas Capture or Use of Biometric Identifier Act, and the Washington Biometric Privacy Act. We receive only the verification result (e.g., a confirmation that your identity was successfully verified) and do not independently store the underlying biometric scans. By completing identity verification, you acknowledge and consent to Plaid's collection and use of your Biometric Data for this purpose.

We do not sell, lease, trade, or otherwise profit from Biometric Data. Section 13.6 Data Retention

We retain personal information for as long as necessary to fulfill the purposes for which it was collected, including to operate your account, provide our services, and comply with applicable legal, tax, accounting, and regulatory requirements. Because we are subject to Know Your Customer (KYC), Anti-Money Laundering (AML), and other regulatory record keeping obligations, and because we use identity, account, and transaction data to detect and prevent fraud, multi-accounting, bonus abuse, and other prohibited conduct across current and future accounts, we generally retain your personal information for the duration of your relationship with us and for an extended period thereafter, which in many cases means we will continue to retain certain data for as long as we operate the platform.

This includes retaining certain categories of information — such as identity verification records, transaction and gameplay history, and fraud-prevention data — even after you close or deactivate your account, in order to: (a) comply with record keeping obligations under applicable law (including federal Bank Secrecy Act requirements and state fantasy-sports or gaming record keeping rules); (b) detect, investigate, and prevent attempts to circumvent account restrictions, including through duplicate or unauthorized accounts; and (c) establish, exercise, or defend legal claims. Where retention of specific data is no longer necessary for these purposes, or where required by applicable law, we will delete, anonymize, or restrict further use of that data.

13.7 Your State Privacy Rights

Depending on your state of residence, you may have certain rights regarding your personal information under applicable state privacy laws (such as the California Consumer Privacy Act, as amended by the California Privacy Rights Act, and similar laws in other states). Subject to certain exceptions and limitations under those laws, these rights may include the right to:

  • Know and access the personal information we have collected about you;

  • Correct inaccurate personal information;

  • Delete personal information we have collected about you;

  • Opt out of the "sale" or "sharing" of your personal information, and of the use of your personal information for targeted advertising, to the extent applicable;

  • Limit the use of sensitive personal information, where applicable; and

  • Not be discriminated against for exercising any of these rights.

14. User-Generated Content

14.1 Ownership & License

You retain ownership of any content you post, share, or transmit through the platform. However, by posting or submitting content, you grant us a worldwide, perpetual, royalty-free license to use, reproduce, publish, and distribute that content for purposes including moderation, promotion, and display.

14.2 Content Moderation

We may, but are not obligated to, monitor and moderate user content. We reserve the right to remove any content that we determine violates these Terms or our community guidelines, or that is otherwise inappropriate, without notice.

14.3 Copyright (DMCA Process)

If you believe your copyrighted content has been used on our platform without authorization, you may submit a DMCA notice. We will respond in accordance with the Digital Millennium Copyright Act, including by removing the reported content if appropriate.


15. General Provisions

15.1 Force Majeure

We are not responsible for any failure or delay in performance caused by events outside our reasonable control. This includes, but is not limited to, acts of God, natural disasters, war, terrorism, labor disputes, embargoes, cyberattacks, pandemics, utility outages, infrastructure failures, or changes in laws or regulations that impact our ability to operate. These events do not excuse your obligation to pay owed amounts or comply with any restrictions imposed under these Terms.

15.2 Assignment

You may not assign, delegate, or transfer your rights or obligations under these Terms without our prior written consent. Any unauthorized assignment will be void. We may freely assign or transfer our rights and obligations without restriction or notice to you.

15.3 Entire Agreement

These Terms (including any policies or documents linked herein) constitute the entire agreement between you and Payday regarding your use of the platform. They supersede all prior or contemporaneous communications, whether oral or written, relating to the subject matter of these Terms. If any part of these Terms is held unenforceable, the remaining sections will remain in full force and effect.
